About us and these terms
ListingForge is run by [legal name of the business] of [registered or business address]. You can reach us at hello@listingforge.com. By creating an account you agree to these terms. ListingForge is independent, and isn't affiliated with or endorsed by eBay Inc.
What the service does
You choose a design, enter your product details and photos, and we generate HTML to paste into your eBay listing. We don't publish anything to eBay for you, and we don't sell anything on your behalf.
Your account
You must be 18 or over and give accurate details. Keep your password private, as you're responsible for what happens under your account. You can delete your account at any time from Account settings, after cancelling any active subscription.
Plans, payment and cancellation
- Paid plans are monthly subscriptions, billed through Stripe at the price shown when you subscribe. They renew each month until you cancel.
- You can cancel at any time from your account. You keep your plan until the end of the paid period, and it then moves to the free plan.
- Each plan has limits on generations, saved listings and storage, shown on the pricing page. Only successful HTML generations count towards your monthly limit.
- If we change a price, we'll tell you at least 30 days before it applies, so you can cancel first.
Your right to cancel within 14 days
If you're a consumer, you normally have 14 days from subscribing to cancel for a refund. When you subscribe you can ask us to start the service straight away. If you then use it, for example by generating HTML, you agree that you lose this right to cancel for that digital service once it has been provided. [confirm with your adviser, and add the matching tick box at checkout if required]
Nothing in these terms affects your legal rights as a consumer.
Your responsibilities on eBay
You're responsible for your listings, including that they're accurate, lawful and follow eBay's rules. We check generated HTML against the eBay rules we know about, but eBay can change its rules and decides what it allows. We can't promise that any listing will be accepted, or how it will display or sell.
What you upload
Your photos, logos and text remain yours. You give us permission to store, process and display them only to run the service. You confirm that you have the right to use them, and that they aren't illegal, misleading or infringing anyone's rights. We may remove content or suspend accounts that break these terms.
Images in your live listings
Your listings load photos from our storage. If you delete a photo or your account, those photos will stop showing on any eBay listing that uses them. Replace them on eBay before you delete anything that a live listing still needs.
Our designs
The designs, templates and site remain ours. While your account is active, and afterwards for listings you created during that time, you may use generated HTML in your own eBay listings. You may not resell, share or redistribute the designs or the generated HTML as templates.
Custom design work is quoted separately, and the quote sets out what you receive.
Acceptable use
Don't try to get around plan limits or security, access other people's data, overload the service, or use it to promote anything illegal, counterfeit or fraudulent.
Availability and changes
We work to keep the service running, but we can't promise it will never be interrupted. We may improve or change features. If we plan to end the service, we'll give at least 30 days' notice.
Our liability
We don't limit liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit. If you're a consumer, we're responsible for loss that is a foreseeable result of our breaking these terms.
If you use the service for business, we aren't liable for lost profits, lost sales or lost business, and our total liability in any 12 months is limited to the amount you paid us in that period. [have this clause reviewed, as most sellers using this will be businesses]
Law and disputes
Please contact us first if something goes wrong. These terms are governed by the law of England and Wales, and its courts have jurisdiction, though consumers living elsewhere in the UK may also bring claims in their local courts.
Changes to these terms
If we change these terms in a way that matters, we'll tell account holders by email before the change applies. How we handle your data is covered by our privacy policy.
